Motor vehicle accidents: Head-on crash kills day care van driver

On Behalf of | Nov 12, 2018 | motor vehicle accidents

Following the tragic death of another driver, a 38-year-old North Carolina man might face a civil lawsuit along with criminal charges that could put him in prison for many years. The number of motor vehicle accidents that involve alcohol and drug impairment is frightening, resulting in the loss of many innocent lives. On a recent Tuesday afternoon, a 39-year-old day care van driver lost her life in such an accident.

According to the North Carolina State Highway Patrol, an employee of a plumbing company failed to remain on his side of the roadway while traveling on a Smithfield road at about 4 p.m. He allegedly crossed into the opposite lane and smashed head-on into a van carrying elementary school children. None of the children suffered serious injuries, but the vehicle landed in a ditch, and the driver became trapped inside.

Sadly, she did not survive the crash. The driver who crossed over the centerline told the court that he was undergoing methadone treatment. He is facing felony DWI and death by motor vehicle charges. Reportedly, the owners of the plumbing company claim to have been unaware of the driver’s impairment on the day of the crash.

The surviving family members of those whose deaths in motor vehicle accidents are caused by the negligence of other parties may pursue claims for financial relief by filing wrongful death lawsuits in civil court. In cases such as this one in which the at-fault driver was using a company vehicle, the business owners could also be named as defendants along with the driver. The support and guidance of an experienced North Carolina wrongful death attorney can be a valuable asset throughout the ensuing legal procedures to recover documented monetary damages.
