Helping You Receive Permanent Disability Benefits in Cary, NC & Beyond
Under workers’ compensation law in North Carolina, workers who have been permanently injured on the job are eligible for benefits based on whether they can or cannot return to work due to their disability.
Permanent Partial Disability
Permanent partial disability benefits are paid to workers who have a permanent physical impairment but are able to return to some type of employment. These benefits are paid to the injured worker based on a disability rating provided by the authorized treating physician or a wage difference claim if able to return to work at a lower rate of pay.
Permanent Total Disability
If a worker is unable to return to any kind of employment following an on-the-job injury, he or she is entitled to permanent total disability benefits. These benefits are defined as two-thirds of the worker’s wages for a period up to 500 weeks from the date of injury or longer, depending on the injury. Entitlement to benefits is subject to the worker’s restrictions, job experience, training and available jobs in the area.
In order for an injured worker to receive total disability benefits, they cannot be capable of returning to any type of suitable employment, even if it is part-time or a lower paying job.
If you believe you or a loved one have become permanently disabled due to a job-related injury, please do not hesitate to contact Ledbetter & Titsworth. We will do everything in our power to get you the compensation you deserve.
